PRIVACY POLICY

In the course of Pier Advisory’s business, there will be times where we collect personal information. This Privacy Policy exists to ensure that such information is handled appropriately. Pier Advisory takes personal information very seriously and is committed to complying with the Privacy Act 1988.

The Privacy Act incorporates the National Privacy Principles and, except where outlined in this Privacy Policy, personal information held by us will be treated in accordance with those Principles.

In this Privacy Policy, “Pier Advisory” refers to Pier Advisory Pty Ltd (ABN 28 154 173 298).

Coverage of Privacy Policy
This Policy applies to any persons in respect of whom Pier Advisory currently holds, or may in the future collect, personal information.

This Privacy Policy applies to personal information. ‘Personal information’ is information or an opinion, whether true or not, regarding a person where the identity of the person is apparent or can reasonably be ascertained from the information or opinion.

In this Privacy Policy there are also references to ‘sensitive information’. ‘Sensitive information’ is information or an opinion about a person’s racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual preferences or practices, criminal record or health. Sensitive information is a subset of personal information.

Information NOT considered to be personal information
Information where we remove any reference to a person and provided that the identity of the person can no longer be ascertained from the information, is not considered personal information.

We may use this information for our own purposes, including commercial gain. For example, statistics from website usage which cite a percentage of users as being from New South Wales, is not personal information.

Collecting personal information
We collect personal information in a variety of ways in the course of conducting business, including but not limited to:

. providing goods and services to clients;
. responding to questions or interacting with people via electronic or written means regarding our service proposition and our business; and
. conducting market research.

Where reasonable and practicable, we aim to collect personal information directly from the person and inform the person at the time that this is being done.

In some instances, it is necessary for Pier Advisory to gather personal information through third party service providers (eg PayPal for electronic transactions) or from a source of publicly available information (eg websites).

Collection of sensitive information
We will not collect sensitive information without the consent of the person to whom it relates unless the collection is required by law.

Usage of personal information
The use to which we can put personal information depends on the reason for which it was collected.

We may use personal information for its primary purpose of collection (eg delivering goods ordered) or for any related secondary purpose where we could reasonably be expected to use personal information.

In certain circumstances, Pier Advisory may use personal information for promotional or direct marketing purposes. However, a person may at any time request us not to use their personal information for sending direct marketing material to that person. Such a request can be made by contacting Pier Advisory via email or post using our contact details below, with no fee for making such a request.

Disclosure of personal information
Pier Advisory respects the privacy of personal information and we will take reasonable steps to keep it strictly confidential.

We will disclose personal information to third parties if it is necessary for the primary purpose of collecting the information, or for a related secondary purpose, if the disclosure could be reasonably expected (eg providing an address to a courier for the purpose of delivering goods ordered).

The only other instances where we may disclose personal information to third parties without the consent of the person to whom it relates if the disclosure is:

. necessary to protect or enforce Pier Advisory’s legal rights or interests or to defend any claims;
. necessary to prevent or lessen a serious threat to the health or safety of a person; or
. required by law.

We will never sell personal information without first obtaining the consent of the person to whom it relates.

Disclosures of personal information as governed by this Privacy Policy cover a geographical remit of Australia and overseas.

Security of Information
Pier Advisory will take all reasonable steps to ensure that all personal information held by us is secure from any unauthorised access or disclosure. However, we do not guarantee that personal information cannot be accessed by an unauthorised person (eg a hacker) or that unauthorised disclosures will not occur.

We will take reasonable steps to either destroy or permanently de-identify personal information, if it is no longer needed for the purposes for which we are authorised to use it.

Accessing personal information
A person may request to access personal information about them held by Pier Advisory. Such a request must be made in writing to the address below.

We will grant a person access to their personal information as soon as possible, subject to the circumstances of the request.

A request to access personal information will be rejected if:

. providing such access would unreasonably impact someone else’s privacy;
. providing such access would pose a serious and imminent threat to the life or health of any person;
. providing such access would prejudice our legal rights;
. there are other legal grounds to deny the request; or
. the request is deemed frivolous or vexatious.

We may charge a fee for reasonable costs incurred in responding to an access request. Any such fees will be disclosed prior to it being charged.

Correcting personal information
Pier Advisory will take reasonable steps to ensure the accuracy of the personal information we hold. However, if a person believes that any personal information we hold about them is inaccurate or out of date, then they are invited to contact us in writing at the address below.
